Westhills Baseball, Inc. Terms and Conditions

PLEASE READ THE ACKNOWLEDGMENT AND WAIVER CAREFULLY
PLEASE ACKNOWLEDGE THE FOLLOWING CONDITIONS BY PLACING YOUR INITIALS IN THE BOX AT THE BOTTOM OF THIS FORM
    * I am aware that (a) my child must reside within the boundaries of Westhills Baseball as assigned (or approved) by PONY in order to be eligible to play in the PONY National Tournament and (b) according to PONY rules my child may not participate in another PONY league at the same time. I acknowledge that my child will be disqualified from National Tournament play if (a) it is found that he/she does not meet the league age requirements; (b) he/she does not legally reside within the assigned (or approved) boundaries of Westhills Baseball; or (c) he/she has participated with more than one PONY league at the same time.    * Players must tryout to be eligible for team selection. Players will be drafted onto teams at the manager's discretion. League officials do not assign players to teams, and Westhills Baseball cannot accommodate special requests for team assignments.    * In the unfortunate event that there is an insufficient number of qualified managers and coaches to formulate enough teams to accommodate every child who signs up, Westhills Baseball may not be able to place every child on a team and a waiting list may be created. *  In the event a player withdraws from the program before assignment to a team the registration fee will be refunded minus a $20 processing fee.  * In the event a player withdraws from the program after assignment to a team, the registration fee paid may not be refunded. Westhills Baseball, in its sole discretion, reserves the right to determine refunds based upon the specific circumstances.   * All refunds will not be processed until approximately 4-6 weeks from the close of season draft.  * Except as permitted under current published league rules, Westhills Baseball does not permit players who participate on other non-school baseball teams during the same time that our program is underway to also participate in our program.    * The parent/Legal Guardian of the Player named above must sign a Westhills Baseball Waiver and Release of Liability (Player) form.    * Westhills Baseball is not a local parks program, nor does it receive any government funding. Instead, we are a privately-funded, non-profit organization that relies on registration fees and fund-raising efforts to finance our activities. We operate a Snack Shack to generate revenues that serve to reduce registration fees. However, we must have the participation of our entire membership to operate the Snack Shack.

Accordingly, THE FOLLOWING IS REQUIRED OF EVERY MEMBER FAMILY:1. Sign up for, and complete, the following Snack Shack shifts:(a) Winter Ball: One (1) four – hour shift- One (1) $150 deposit check is required at the time of registration(b) Spring Ball: Two (2) three-hour shifts- Two (2) $150 deposit checks are required at the time of registration 2. The deposit check will be returned after the satisfactory completion of the shift.3. PARENTS/LEGAL GUARDIANS ONLY are permitted to work their family’s snack shack shift(s). No exceptions.4. Each Snack Shack shift may only be rescheduled once per season. To cancel and reschedule a snack shack shift, you must provide provide notice pursuant to currently published Snack Shack Rules & Regulations. If you fail to provide such notice, you will not be given an opportunity to reschedule and YOUR DEPOSIT CHECK WILL BE CASHED.
Waiver and Release of Liability (Player)
“Player” desires to participate in baseball related activities and events which include, but are not limited to, instruction, training, practice, exercise and transportation to and from the activities and events ("Activities") with Westhills Baseball, Inc. its agents, representatives, employees, independent contractors, principals, officers, directors ("Westhills Baseball, Inc."), PONY Baseball, Inc. its agents, representatives, employees, independent contractors, principals, officers, directors ("PONY Baseball, Inc."), and/or any other third parties and participants in the Activities.
Player is fully aware that the Activities may be dangerous and cause injuries including, but not limited to, minor injuries (i.e. sprains/strains), serious injuries (i.e. fractures/permanent disability), or death. Player understands the risks involved and expressly assumes all risks and voluntarily chooses to participate in the Activities.
Player, in behalf of himself/herself as well as his/her heirs, family members, representatives, agents, insurers, successors and assigns releases, waives, discharges, holds harmless, indemnifies and covenants not to make a claim for damages or bring a lawsuit against Westhills Baseball, Inc., PONY Baseball, Inc. and/or any other third parties and participants for all liability related to the Activities whether caused by passive negligence, active negligence and/or defects in the facilities or equipment whether hidden, latent or obvious.
Player acknowledges that he/she has consulted with a licensed physician and confirms he/she is in good health with no medical problems which may be caused or exacerbated by participation in the Activities. Player authorizes EMT’s, physicians and/or any other qualified medical providers to render medical treatment that may be deemed necessary in the event of illness or injury to Player.
Player agrees that if any portion of this waiver and release is held to be invalid that the balance shall continue in full force and effect.
Player grants Westhills Baseball, Inc. express permission to use any photographs and video of Player’s participation in the Activities for social media, advertising and promotional purposes without compensation to Player or his/her heirs, family members, representatives, agents, successors and assigns.
I am the parent/legal guardian of the minor Player named herein and sign this waiver and release for and in behalf of the minor Player and agree to bind myself, the minor Player, his heirs, family members, representatives, agents and assigns to the terms of the above waiver and release with regard to Westhills Baseball, Inc., PONY Baseball, Inc., and/or any other third parties and participants.
I represent that I have the capacity and authority to act for and in behalf of the minor Player and agree to indemnify and hold harmless Westhills Baseball, Inc., PONY Baseball, Inc., and/or any other third parties and participants for any claims, liabilities or damages assessed against them as a result of any insufficiency of my legal capacity or authority to act for and in behalf of the minor Player in this regard.  PONY Baseball, Inc. reserves the right to collect data from players, parents league officials and umpires.  Collection of this data is govered by the PONY Data Management Policy.


I hereby waive and release, absolve, indemnify and hold harmless Westhills Baseball, Inc., PONY Baseball, Inc., and/or any third parties and participants for any claims or damages arising from the minor Player’s participation in the Activities described herein.
I authorize licensed EMT’s, physicians and/or any other qualified medical providers to render any medical treatment or care that may be deemed necessary in the event of illness or injury to the minor Player.

I acknowledge that I have read the fact sheet for parents on concussion found at www.cdc.gov/HEADSUP with my child or teen and talked about what to do if they have a concussion or other serious brain injury.
I grant Westhills Baseball, Inc. the express permission to use any photographs and video of the minor Player’s participation in the activities indicated herein for advertising and promotional purposes without compensation to the minor Player, his heirs, family members, representatives, agents and assigns.
